1. Introduction
Profits Funnel (“Company”, “we”, “us”, or “our”) operates a software-as-a-service platform that enables users to create, host, publish, and manage marketing funnels and digital content (the “Service”).
We respect the intellectual property rights of others and expect all users of the Service to do the same. This Copyright & Notice-and-Takedown Policy (the “Policy”) establishes the procedures for reporting and responding to alleged copyright infringement
.
This Policy is implemented in accordance with:
the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512) (“DMCA”), as a voluntary notice-and-takedown mechanism; and applicable European Union and Romanian law, including Directive (EU) 2019/790, Regulation (EU) 2022/2065 (Digital Services Act), and Regulation (EU) 2016/679 (GDPR).
Profits Funnel qualifies as a hosting service provider and claims all applicable limitations of liability available under relevant law.
This Policy forms an integral part of, and is incorporated by reference into, the Terms of Service governing use of the Service.

3. Notice of Alleged Copyright Infringement
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that content available through the Service infringes your copyright, you may submit a written Notice of Alleged Copyright Infringement.
To be effective, the notice must include the following information:
1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed, or a representative list of such works.
3. Identification of the material claimed to be infringing and information reasonably sufficient to permit Profits Funnel to locate the material within the Service (such as specific URLs, funnel IDs, page identifiers, or screenshots).
4. Your full legal name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or applicable law.
6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
4. Removal or Disabling of Access to Content
Upon receipt of a valid notice, Profits Funnel will act expeditiously to remove or disable access to the allegedly infringing material, in accordance with applicable law.
Where appropriate, Profits Funnel may:
remove the allegedly infringing content; or
disable access to the content or the relevant portion of the Service.
Profits Funnel will make reasonable efforts to notify the user who posted or controls the affected content (“Affected User”) of the removal or restriction and provide information regarding available remedies, including the right to submit a counter-notification.
Profits Funnel does not proactively monitor or screen user-generated content and relies on notices submitted by rights holders and authorized parties.
Removal or restriction of content under this Policy does not constitute an admission of infringement or wrongdoing.
5. Counter-Notification
If you believe that material you posted through the Service was removed or disabled as a result of mistake or misidentification, you may submit a Counter-Notification.
To be effective, the Counter-Notification must include:
1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location where it appeared before removal.
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
4. Your full legal name, mailing address, telephone number, and email address.
5. A statement consenting to the jurisdiction of the competent courts of Romania and agreeing to accept service of process from the party who submitted the original notice.
Counter-Notifications must be sent to the contact listed in Section 2.
6. Restoration of Material
If Profits Funnel receives a valid Counter-Notification, it may forward it to the original complaining party.
Unless the rights holder initiates legal proceedings within a reasonable period provided by applicable law, Profits Funnel may restore or re-enable access to the removed material.
7. Repeat Infringer Policy
Profits Funnel has adopted and reasonably implemented a policy for addressing repeat copyright infringement.
A user may be considered a repeat infringer if they receive two (2) or more valid copyright infringement notices within a twelve (12) month period. In such cases, Profits Funnel may suspend or permanently terminate the user’s account, in accordance with applicable law and the Terms of Service.
8. Limitation of Liability
Profits Funnel does not control, create, or actively monitor user-generated content.
To the fullest extent permitted by law, Profits Funnel shall not be liable for copyright infringement arising from content provided by users of the Service, provided that Profits Funnel acts expeditiously upon obtaining actual knowledge of unlawful content.
Nothing in this Policy limits any statutory defenses, immunities, or limitations of liability available to Profits Funnel under applicable law.
9. Misrepresentation and Abuse of the Notice Process
Any person who knowingly submits a materially false or misleading notice or counter-notice may be liable for damages under applicable law.
Profits Funnel reserves the right to restrict or refuse processing of notices from parties who repeatedly submit abusive, bad-faith, or manifestly unfounded claims.
10. European Union – Digital Services Act Compliance
In accordance with Regulation (EU) 2022/2065 (Digital Services Act), Profits Funnel provides a mechanism for reporting allegedly illegal content and ensures that affected users are informed of moderation decisions and have the right to contest such decisions.
11. Personal Data Processing
Personal data submitted in connection with notices or counter-notifications is processed for the purpose of complying with legal obligations related to copyright enforcement, pursuant to Article 6(1)(c) GDPR.
Such data is processed in accordance with Profits Funnel’s Privacy Policy.
12. Governing Law and Jurisdiction
This Policy shall be governed by and construed in accordance with the laws of Romania and applicable European Union law.
Any dispute arising out of or relating to this Policy shall be subject to the exclusive jurisdiction of the competent courts of Romania.
13. Changes to This Policy
Profits Funnel reserves the right to modify or update this Policy at any time. Any changes will become effective upon posting the revised Policy on the Service.
